1. Agreement
These Terms of Use (“Terms”) govern access to and use of DPOcertifications.org operated by DPOCertification.Org. By accessing or using the Platform, creating an account, or clicking to accept, you agree to these Terms and our Privacy Policy and Cookie Policy.
If you use the Platform on behalf of an organisation, you represent that you have authority to bind that organisation.
2. Educational service — not legal advice
The Platform provides educational content, assessments, and credentials related to India’s DPDP framework. Content is for learning and professional development only. It is not legal advice, regulatory approval, government certification, or a substitute for qualified counsel. You remain responsible for your organisation’s compliance decisions.
3. Eligibility and accounts
You must be at least 18 years old and capable of forming a binding contract. You agree to provide accurate registration information and keep credentials confidential. You are responsible for activity under your account.
We may suspend or terminate accounts that violate these Terms, create security risk, or misuse the Platform.
4. Enrolments, fees, and certificates
Free and paid tracks are described on the Platform. Paid enrolments may be processed by third-party payment providers. Except where required by law or expressly stated at checkout, fees are non-refundable once digital learning access is granted.
Certificates and verification codes reflect completion of Platform assessments. They do not constitute a government licence or statutory appointment as a Data Protection Officer.
5. Acceptable use
You agree not to:
- Share accounts, scrape content, or redistribute course materials without permission
- Cheat on exams (including using unauthorised assistance, multi-accounting, or defeating integrity controls)
- Upload unlawful, harmful, or infringing content
- Attempt to probe, disrupt, or bypass security or access controls
- Use the Platform to send spam or process others’ personal data unlawfully
6. Intellectual property
Platform software, branding, curricula, questions, and downloads are owned by us or our licensors. We grant you a limited, non-exclusive, non-transferable licence to use materials for your personal or internal organisational learning. You may not republish or commercialise them without written consent.
7. Enterprise / organisation features
If an organisation administers seats, that organisation may control membership, view progress, and process learner data as an independent or joint Data Fiduciary for employment/training purposes. Learners should also review their employer’s policies.
8. Privacy and cookies
Personal data is processed as described in our Privacy Policy. Cookie preferences are managed via Complynz as described in our Cookie Policy. By using the Platform you acknowledge those notices.
9. Third-party services
The Platform may integrate authentication, hosting, payments, news feeds, and consent tools (including Complynz). Third-party terms and privacy practices apply to their services. We are not responsible for third-party sites linked from news or resources.
10. Disclaimers
THE PLATFORM AND CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant uninterrupted or error-free operation, or that content is complete for any compliance programme.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR CLAIMS ARISING OUT OF THE PLATFORM IS LIMITED TO THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM (OR INR 5,000 IF YOU USED ONLY FREE FEATURES).
12. Indemnity
You agree to indemnify and hold us harmless from claims arising out of your misuse of the Platform, violation of these Terms, or infringement of others’ rights, except to the extent caused by our wilful misconduct.
13. Suspension and termination
You may stop using the Platform at any time. We may suspend or terminate access for breach, legal risk, or Platform discontinuation. Provisions that by nature should survive (IP, disclaimers, liability limits, indemnity) will survive termination.
14. Governing law
These Terms are governed by the laws of India. Courts at New Delhi, India shall have exclusive jurisdiction, subject to mandatory consumer protections that cannot be waived.
15. Changes
We may update these Terms. Continued use after the updated “Last updated” date constitutes acceptance, except where mandatory law requires additional consent. Last updated: 22 August 2026.
